Subject: A THOROUGHLY CORRUPT UPA GOVERNMENT

Dear Friends,

The Article below has reference to the Government corruption in the Air Force Naval Housing Board but it reaches all aspects of corruption from the top down in the UPA and shows how all the major Government institutions were subverted in the service of the " Family". Particularly hard hit are the Armed Forces Of India. Read for yourself and also understand how the Defence Capability of the country has been compromised. In the interests of the people please circulate it as widely as you can.RajeshA THOROUGHLY CORRUPT UPA GOVERMENTThis article is a continuation of a letter written to the Defence Minister recently and which has been reproduced below as attachment as proof of the conclusions arrived at in this article. The serious reader may also like to read the attachment and draw his own conclusions.2. The story commences with the floating of the “Farm Unit scheme” by the Air Force Naval Housing Board ( AFNHB). The AFNHB scheme for Farm Units was started sometime in 1995 and construction started in earnest in 1998. The likely date of completion of all facilities was Sep 1999. The Farm scheme consisted of three sectors, X, Y and Z. There was no problem in the X and Z sectors and they were handed over in reasonable schedule. With the Y sector the problem started at its inception. Vice Admiral Sushil Kumar, who was then in charge of the Y Farms project as chairman, AFNHB in 1996 inducted a certain Lt Cdr Daryao Singh, a retired Officer of the Navy as developer for the Y scheme. Daryao Singh had no previous experience in land development being a retired Navy Officer nor did he meet the QRs for developers. While the owners were charged Rs 2,40,000/- for the land and development the market price for the land was approx Rs 60,000/- per acre. In the process Sushil Kumar and Daryao Singh acquired land for themselves as well. Sushil Kumar acquired approximately 26 acres and Daryao Singh about 30 acres. Sushil Kumar claimed that he sold his Mother’s Jewelery and Lands to fund the purchase. Daryao Singh had no explanation about how he came to fund the land. Daryao Singh is known to have built Sushil Kumar’s farm house. Sushil Kumar also owns two homes in Sector 21 Noida, Two flats in Ranikhet, a bungalow in the Andamans and the Farm House on over 4 acres of land adjoining Y Sector. The source of funds for these purchases has not been examined. Till today there is no accounting for the 281 acres of land acquired by Daryao Singh.3. From the amount charged to the owners for the land plus next installment, a road was supposed to be built connecting the Faridabad- Majhawali road to the farms. The road was never built. The money was not refunded either. This represented a serious breach of contract by the AFNHB as the farms were not accessible then by road and they are not accessible today even 18 years later.4. Comes the UPA into the picture in 2004. Sushil Kumar had by now covered himself in glory as the former Navy Chief through the Barak Missile deal and he was under the CBI scanner. This was also about the time that Robert Vadra had started acquiring extensive properties in Haryana and Rajasthan and elsewhere under dubious circumstances. Robert Vadra himself was a lightweight and nothing more than a costume jewelry maker but he was helped in these deals by the mentor of the Gandhi children, Satish Sharma. The Rasputin behind the throne. Satish Sharma put two and two together and came up with a sum of 281 acres of land that could be had if the Owners were convinced to sell the land collectively at a cheap price to a builder. The Builder in this case being DLF. The President of the Owner’s association was roped in to sell this idea by Sushil Kumar. Unfortunately, dim as they normally are in financial matters, some Service Officers saw the potential of the farms with the Greater Noida Metropolis coming up nearby. The Chief Of Air Staff at that time was even obliged by Sharma to make an offer to the owners to give back their land to the AFNHB at original price plus 9 % interest, obviously for resale to DLF.5. The Y farms scheme was running shamefully when Air Marshal JN Burma, who is currently Adminstrative Member, Armed Forces Tribunal, took over as Chairman of AFNHB in 2006. Having inherited a problem, one would assume that the Air Marshal would work to set things right. That was not the case. Robert Vadra moved in in a big way and acquired about 500 acres in the vicinity of Y Farms. Mahesh Nagar, his principal purchase agent appeared in Y Farms as well. Suddenly, some UP Govt agency declared the farm units illegal and unauthorized. The identity of this UP Govt agency was unknown/not revealed to the owners by Burma. It was decided by Burma to take up this matter at the highest political levels. The CBI inquiry conducted after the departure Of Air Marshal Burma found that it was merely the Director of Industries of the UP Govt who had declared the area notified. Something he was not authorized to do. The issue never got resolved in the six year tenure of Burma. On 24 July 2007 Burma assured the residents association that he would meet CM Mayawati and the Raksha Mantri. This again never happened. Why would Air Marshal Burma tell lies/use perverse application of mind to sabotage the Y Farms scheme?6. Just prior to Burma taking over as Chairman AFNHB, mutation of some of the farms had been cancelled by the Tehsildar through a mischievous and perverse order. Strong suspicion exists that Daryao Singh was the conduit whose help was obtained in passing this controversial order. Burma claimed that he was in constant touch with Chief Secy UP to rectify the situation. Again nothing happened. In September 08. 2007 Burma persuaded the Service Chiefs to stop further expenditure on Y site. Thereby leaving the life savings of 280 officers and men in the lurch even till today. There is no doubt that Air Marshal Burma was elevated after retirement to the post of Administrative Member AFT as quid pro quo for services to the family. Is it small wonder then that he would destroy the ethos and discipline of the Services in the Sukhna Scam case to save another land thief of a Corps Commander and to please the Ministry Of Defence only just to show up General VK Singh as a vindictive man. That the Family and the MOD would go to any lengths to preserve their power even to the extent of treason is revealed by the leak from the PMO of a Top Secret letter laying India’s deficiency in defence bare and in the story of a “ coup”. Dismantling the covert Technical Services Division, a vital and unique national asset is another case in point.7. Additionally, the developer, Daryao Singh had also been dismissed by the AFNHB and the Developer went to Court and got a stay order. This dismissal was engineered to cover the tracks of the large scale defalcations and stop development on grounds of “dispute”. The Matter went into arbitration and has been in arbitration ever since. The first lien of the land was given illegally by the AFNHB to the developer who was just working on turnkey basis. This lien was subsequently declared outside the terms of agreement and ultra –vires by judgment of the Delhi High Court. It should have been apparent to any Judge worth his salt that the lien was mala-fide. Yet it took 10 years to get this abuse of process of Court resolved. It does not take rocket science to figure out that the Judgments under UPA were controlled by the Chief Justice giving directions from the top where the Govt (read family) was an interested party. The guilty personnel of AFNHB and the Service Headquarters who misappropriated the rights of the owners to their property in the lien case have still not been identified.8. Letters to the Raksha Mantri, Shri AK Antony written as far back as 2007 had no effect despite the scam being worth Rs 28 crores then. Today on the basis of appreciated prices it is worth Rs 300 crores. On the outcry by the owners, a Court Of Inquiry was ordered on the Y farms project by Air Headquarters. A presentation on this court of Inquiry was given to the Naval Chief and the Air Chief on 24th April 07. No action was taken by either of the Service Chiefs. The Court Of Inquiry was suppressed on technical grounds. It can be seen that the power of Vadra/ Sharma over the Service Headquarters is complete. Is it small wonder then that even the arms purchases running into billions of rupees are pre-decided based on the kick- backs offered and the QRs for the service equipment written to suit the politicians? The Westland case is only a small drop in the bucket. Now does the reader understand why it is absolutely necessary for a Service Chief to be appointed in a line of succession? His background can then be vetted and if he is too much of a professional with no weaknesses he can be quietly eliminated in the few years of service before he becomes the Chief. Most regretfully the BJP has continued this policy under Arun Jaitley. When Lt General Tejinder Singh walked into the Army Chief’s Office to represent the Tatra case he expected business as usual and he would get the signatures of a compliant Chief, perhaps for a little extra payment considering the file was held up. An incorruptible VK Singh came as a shock. Whoever it was in MOD who recommended appointment of Gen VK Singh as the Chief should have been shot for gumming up the works. The damage being done, typically, in line with the UPA Government’s penetration of all institutions in the country, the CBI stepped in to provide cover by filing a closure report.9. When the situation at the farms finally blew up through the expose’ by Rahul Singh of the Hindustan Times, a CBI inquiry was reluctantly ordered in 2012. By admission of the CBI inspector himself this inquiry was ordered by a sketchy DO letter from the Ministry Of Defence which gave very little information despite the “masala” provided by Rahul Singh. For the next two years the CBI continued with the inquiry while the Farms project again went into limbo. In 2014, very predictably, the CBI filed a closure report.10. The Ministry Of Defence , who initiated the Inquiry, should have been the watchdog to ensure that justice was given to the Farm Owners. Shockingly, at the very first hearing itself the MOD filed a no objection to the closure report. This, despite the complete absence of the main “dramatis personae” Sushil Kumar in the closure report. This “ No Objection “ was filed under the UPA Government and the closure report itself was filed under the Directorship of Ranjit Sinha whom the Supreme Court was obliged to dissociate from the 2 G Scam investigations at a subsequent date. Daryao Singh, the developer associate of Sushil Kumar in the meantime went on to greater glories by landing up in Jail. The Times of India has this to say:“ GURGAON: The managing director of real estate company Vigneshwara Group and two of his family members have been booked by Gurgaon Police in a multi-crore fraud case. Some estimates put the scale of the fraud at more than Rs 1,000 crore.”11. Not content with just giving lien to the developer, the AFNHB also employed a servant of the Developer as a Security in charge of the area. This security in charge has been indulging in all sorts of criminal activities to discourage the owners from moving into the farm houses. The employment of a servant of Daryao Singh as security agent in Y Farms despite clear court order of the Delhi High Court externing Daryao Singh, his servants and agents clearly shows the complicity between Daryao Singh and officials of the AFNHB. This security agent has attacked the legitimate residents of the Y Farms causing grievous injuries and damage to property. He is even in collusion with the Police who refuse to register cases or file FIRs. The Owners have also been threatened with beating by villagers by a Sub-inspector in the office of the SP ( Rural) Gautam Budh Nagar and in his presence. The Farm scheme is in the same area where Durga Shakti Nagpal, an ADM was removed from her post within 45 minutes for carrying out her legitimate duties and which provoked a national outcry. There was also an attempt on her life near the same police station which looks after the farms. Even while out of power, the Vadra/ Sharma combine has influence on the ruling Samajwadi Party in UP and who knows where else.12. The shocking thing here is that under the pressure of the Family, the MOD has shown complete disregard to the interests of the Service Personnel it is bound to protect. The Service person is obliged to serve anywhere in India and generally spends his working life anywhere other than his home town. Leaving his assets defenceless. Under these circumstances, for the MOD to conspire to deprive the Service Personnel of their hard earned lands amounts to nothing short of criminality. The MOD has supreme contempt for even the rank structure of the services. One of the senior victims is a recently retired Commander-in -Chief of the Central Air Command, the other being the Former Commandant of the National Defence Academy, India’s premier training institution. Not to mention a host of Air Marshals, Admirals, Commodores and Air Commodores of the Navy and Air Force respectively.

  1. Still no relief from this distress it is today 17 May 2016. 21 years from the inception of this Y site farm houses. Is this the justice system or the goverment, who is to be blamed? Don't know where our government is headed, they only know how to satisfy their personal interest and they forget that instead of we serving the government officials they are appointed to serve the public. The basic meaning of a govertment servant is also not understood by them then how can we let them govern. Why there is no media coverage for this as much as Adarsh Society. This is because no one has any problem if they were not alloted a farm house in this unit unlike in Adarsh, all the top notch officials who couldn't secure a flat for themselves in Adarsh made it a case of sour grapes. Who is suffering in all this? It is the innocent people who have invested all their life's earnings on these kind of properties.
